January 10, 2007

Pulte Homes Corporation – Westcoat Road

Applicant seeking approval for major subdivision for 670 lots. Project will consist of 261 sfd’s for adult homes with clubhouse facility, 259 sfd’s and 140 lots for fee simple townhouses. This project is bordered by Westcoat Rd., Delilah Rd, Garden State Parkway and East Atlantic Ave (unimproved street). It is the wooded area across from the airport. The commission met with Environmental Consultant Terry Vogt to discuss the environmental implications only of the project. Threatened and endangered species have been sited including Cooper’s hawk and Barred Owl. Preliminary approval is sought at this point with the understanding that further studies must be completed in spring 2007 to verify existence of T&E and take appropriate action to protect the species and their environment. The Pinelands Commission would also get involved. Although the applicant marked numerous large specimen trees on their plan as required, they did not indicate which if any would be saved. We noticed that there is a large area of many specimen trees in the section to be used for town homes and asked that this be revisited with the intention of saving this fast disappearing resource, one of the few remaining forests with large trees in the township. We also asked that if the county allows asphalt walkways along Westcoat Rd., rather than curb and sidewalk, that the walkway be designed to go around the exiting trees. We asked that some of the curb lines be moved in the project to save some additional trees. Many additional trees could be saved with a minor adjustment to the plan. The applicant is asking for a waiver from the prohibition of clear cutting. We asked for justification for clear cutting. Zone: Pinelands R5

Frank Investments Inc – Towne 16 Theatre

Applicant seeking major site plan approval for 60,000 sf, two story entertainment complex to include Hooters Restaurant and R.I.Gators Restaurant. There was no Environmental Impact Statement (EIS) and no request for waiver. Landscaping will be an improvement to current conditions but must have and use irrigation with rain sensors. Zone: Pinelands RCD

A & P Associates LLC – Black Horse Pike

Applicant seeking use and site plan approval for 4 story, 146 unit condo/motel at site of former Verona Bowling Alley in West Atlantic City. We need to know the potential impact of off site drainage and flooding. It might be prudent for applicant to extend the proposed dune at Lakes Bay in front of their property. Zone: CAFRA R5 APT

Charles Peruto Jr. – 224 Pine Avenue

Applicant is seeking approval for 25 lot subdivision at site of Iron Gate Farm. We need to see required EIS. Need a tree survey as required. Make sure trees of 8" and over are marked and preserved. This has been referred to Environmental Consultant due to CAFRA designation and proximity to Atlantic County open space. Zone: CAFRA RA

Riddgewood Point, LLC – Delaware and Tremont

Applicant seeking approval for 13 lot subdivision, 12 sfd’s and 1 basin. Application needs Environmental Impact Statement (EIS). We suggest a substitute evergreen for proposed Atlantic White Cedars as they are a wetlands plant. Trees are marked as required and some are supposed to be preserved as marked on plan, make sure they are protected from construction and preserved. Zone: Pinelands RG1

Ma-Len Enterprises LLC – Ocean Heights Avenue

Applicant seeking site plan approval for 20,000 sf combination retail/restaurant shopping center with two free standing signs. This is the area between the horse farm and car wash by English Creek Ave. We asked that trees be marked and preserved in accordance with township ordinance. We would like to see an enhanced landscaping plan. Zone: CAFRA NB

Beazer Homes New Jersey – Franklin Ave and Black Horse Pike

Applicant seeking approval for 59 lot subdivision, 56 sfd’s, 1 basin, 2 lots located in highway business zone to remain vacant at this time. We reviewed this application in December 2006. We suggest deed restricting the trees that are scheduled to remain as buffers. We suggest having someone on site during site work to make sure there are no accidental clear cuttings. Zone: Pinelands RG & HB

Rugby Reality, LLC – English Creek Ave.

Applicant seeking approval for 10,256 sf two story professional office building. This is in area bordered by DeCarlo Ave. We found the plans impossible to review due to reduced size and asked that proper plans be submitted before this application proceeds. Zone: Pinelands PO

Brysco Enterprises, LLC- Black Horse Pike

Applicant proposing 14,950 sf automotive sales and service establishment. (Matt Blatt) This is east of Ivins Ave. We recommended no waiver for EIS. Ivins Ave is known to contain wetlands. No waiver for landscaped buffer zones as requested. Specimen trees must be marked and protected with fence prior to construction. Eight trees are required along BHP and should be provided by applicant. Zone: Pinelands HB

Eagle Creek Partner, LLC – Ocean Heights and Virginia Aves.

Applicant is proposing lot consolidation in order to create 41 lots for 38 sfd’s and 3 open space lots. These lots are surrounding the existing Ballamor Golf Club. Our Environmental Consultant asked for a plan showing the mature pitch pines they noted on property visit; these trees are endangered and must be preserved. We found no such plan showing the trees. No waiver as requested for required plans showing the species, density and size of trees to be preserved. Individual trees over 15" must be located and shown on plans. No waiver as requested for lot sizes due to the environmentally sensitive nature of this area. This is the head waters of English Creek, a Category 1 stream which flows to the Great Egg Harbor River. There are known Swamp Pink and Lady Slippers in area, verified when golf course was constructed. We asked that applicant produce the required water quality reports for English Creek to show no contamination of English Creek. The deed restricted buffer needs to have a permanent fence prior to start of construction in order to protect it from homeowners and to let homeowners know the extent to which they can clear their lots. No waiver for lot disturbance as requested. Zone: CAFRA R1

DR Horton, Inc – 6603 Mill Road

Applicant is proposing two lot minor subdivisions. This is site of Little Mill development. No comment as this appears to be lot reconfiguration. Zone: Pinelands RG1/RG2

Brysco Enterprises, LLC- Black Horse Pike (McKee City)

Applicant proposing 14,950 sf automotive sales and service establishment. (Matt Blatt) This is east of Ivins Ave. Applicant provided Environmental Impact Statement (EIS) as requested which indicated possible habitat for Barred Owl, a threatened species. We contacted DEP and Township Engineer with information and recommendation to follow up on EIS. There is also a potential for non point water pollution of Patcong Creek and we requested applicant detail steps to avoid this. Application indicates 7 trees of greater than 15" diameter to remain. Zone: Pinelands HB

A& P Associates, LLC – Black Horse Pike (West Atlantic City)

Applicant is proposing major site plan approval to construct 4 story, 146 unit condo/motel at site of former Verona Bowling Alley. We reviewed this application 02-07-07 and recommended extending dunes to protect area from flooding from Lakes Bay. Zone: CAFRA

Bruce McDonnell – Ridge Ave

Applicant is seeking preliminary site plan approval for 11 lots for 10 semi detached sfd’s (duplexes). This is across from Patriot’s Walk. We recommended improved landscaping around basin. Zone: Pinelands RG 4

Holman Enterprises – Black Horse Pike (English Creek)

Applicant is seeking second amendment to update and replace signs. No comment. Zone: Pinelands HB and RG 5.

Cellco Partnership – Steelman Lane

Applicant is seeking condition use variance and site plan approval to construct 120 ft. monopole with 12 antennas and a high fenced compound. We asked that tower have blinking white light rather than steady red light to prevent birds from flying into it. This would also depend on FCC rules. Zone: CAFRA RCD

Wesley Starn – Old Zion Rd and Garden State Parkway

Applicant proposing a 6 lot subdivision of which 5 will be utilized for new sfd’s and existing house to remain. This is the area of Old Zion Rd across the street from Little Mill development. Although an Environmental Impact Statement EIS summary was available, a complete EIS is required by ordinance. We asked that the many mature trees on this property be preserved by realigning driveways and providing a meandering sidewalk. A Cultural Resource Survey is also required. Zone: Pinelands RG 1

K. Hovnanian – Bayberry Ave

Applicant is proposing to subdivide 3 existing lots to create 4 lots of which 3 will be used for new sfd’s and existing house to remain. Lot disturbance of Lot 17 exceeds 20% allowed. Zone: Pinelands RG 1

William Sapio – West Parkway Drive and Chestnut Ave

Applicant is seeking preliminary/final major site plan approval to construct two office warehouse buildings and parking spaces and basin. The plans were undersized and we had a difficult time reading them and could not delineate wetlands. We request attention to be paid to amount of impervious cover, particularly in parking lot which may be able to be covered with stone rather than asphalt. Other comments withheld in hopes of getting better plans. Not knowing what warehouses will be for, care may need to be taken for disposal of hazardous materials. Zone: GC

October 3, 2007

James and Jackie Carney – Spruce Ave and Harvest Ct.

Applicant proposing to a two lot subdivision of which one lot will contain existing sfd and the other lot will be used to construct a sfd. We had no comment. Zone: Pinelands RG2

J & M Land Company – Delilah Rd and English Creek Ave

Applicant is proposing to construct a 5367 sf professional office building with 27 parking spaces. Previous approval relieved in 2002 for 10800 sf building so this is for a reduction in size. We requested an Environmental Impact Statement (EIS) as required. We asked that required street trees be planted and a sprinkler system for the parking islands. We could not see the proposed landscaping plan as the plans were too small; we requested readable plans. Asked applicant to identify the effect of impervious surface on flooding. Zone: Pinelands PO1 .

Clayton Development Associates – Robert Best Rd,

Applicant proposing to subdivide 26.9 acre parcel of which 18 lots will be used for sfds and 2 lots for basins. This is on Robert Best between Academy Rd and Cindy Dr. We also reviewed plans in 12-06. An EIS is needed. NJDEP data base suggest this is habitat for barred owl, Cooper’s hawk and sharp skinned hawk. Because of this we asked that a qualified professional study the area at the appropriate time to make a determination of presence of threatened and endangered species. We asked that no variance be given to reduce lot sizes or perimeter of basin area. We asked for no waiver as requested for identifying the size and species of trees to be preserved, as this is a heavily wooded area. We asked that lots with wetlands present be deed restricted so future residents will not disturb and asked that a permanent fence indicating area not to be disturbed be put in place prior to construction so buyers can understand what the deed restrictions will mean to their individual lots. Applicant proposing four story, 120 room extended stay hotel with freestanding sign. Need sprinkler system with rain sensors in parking lot islands. Zone: Pinelands HB

Bruce McDonnell – Ridge Ave.

Applicant is proposing 10 semi detached duplexes totaling 20 living units. This is the area of Ridge between BHP and Delilah Rd. The Environmental Impact Statement (EIS), while present was barely adequate. We asked for improved landscaping around the basin, including plants with berries and flowers in order to act as a wildlife habitat. No waivers for basin size, as requested. Remove potentially hazardous debris on property with care Zone: Pinelands RG4

Bellevue Property Group – Black Horse Pike and Washington Ave

Applicant seeking preliminary major site plan approval for a two story 13,550 sf professional office building at the site of the now closed WaWa.(Cardiff Circle) Project will consist of AtlantiCare office building as an Emergency Medical Services Operation and EMS train institute. There was no Environmental Impact Statement (EIS) with application. Need to improve landscaping plan. No removal of 18" oaks which are on the edges of the retention basin area; these trees can be preserved. Need sprinkler system with rain sensors in parking lot area. Due to the potential of ground water contamination we suggest a Phase I Audit. Zone: Pinelands HB

Bennie Management Inc. – Mill Rd

Applicant is proposing a four lot subdivision for 4 sfd’s. No EIS present. We suggest no waiver from showing the presence/absence of wetlands. Threatened and endangered species potential pending EIS. Why is applicant asking for waiver from soiling boring? Why does application state area will be serviced by well water? Zone: Pinelands RG1.

Johnston Enterprises Inc. – Washington Ave and Fire Rd.

Applicant seeking major site plan approval for two story 15,600 sf office building. Project will entail the re-alignment of lot lines between lot 11 and 33 to create a 4.5 acre parcel for the building. This is next to existing Eastern Transit Mix Concrete plant. No EIS present. Sprinklers needed for parking islands with rain sensors. We would like to see a landscaping plan around the building; none present. Due to potential of hazardous air borne materials there should be a Phase I audit. Zone: CAFRA M1

John Mirenda – English Creek Ave.

Applicant is seeking major site plan approval for 10,558 sf two story office building. Existing sfd to be demolished, existing storage garage to remain. This is in the area of William Ave. Environmental Impact Statement (EIS) is required. There is no landscaping around the retention basin; we suggest a mix of trees and shrubs. Although it is at the rear of the property, the basin could still function as a wildlife habitat also. Need sprinkler system in parking lot islands. We do not support the requested waiver from a mature tree study. No wetlands are delineated. Pursuant to the Environmental Commission’s authority under EHT ordinance, we designate two trees on this property to be specimen trees and to be preserved. One is a mature oak located between English Creek Ave. and the existing utility pole on northeast corner of property. The other is the mature tree located in front of the existing house. This will require a redesign. We will not support this plan as presented. Zone: Pinelands PO1.

Pashley Builders, Inc. – 2501 Fernwood Ave

Applicant seeking major site plan approval for 48,600 sf of office/warehouse space. This is on north side of BHP in vicinity of Delilah Oaks. This is a totally wooded area and a mature tree study needs to be done. The EIS calls for clear cutting the site which we oppose. There is virtually no buffer around the retention basin and there is no room for landscaping the basin which needs to be done. There is no buffer between the site and the existing mobile home park. There needs to be a buffer and landscaping in order for the activity and traffic and lights not to intrude on the residents. No waiver from delineating wetlands. No landscaping around the building because there is no room. This application appears to be too large for the site, not allowing for the proper buffers and landscaping. Zone: Pinelands, HB

Pashley Builders Inc. – 2501 Fernwood Ave

Applicant seeking major site plan approval for 48,600 sf. office/warehouse space. We reviewed this application 01-09-08 and objected to the clear cutting proposed and lack of buffers between site and nearby mobile home park. We also asked for a mature tree study which has now been provided indicting presence of several 18" plus diameter trees to be removed. We are still concerned about the impact of this development on neighboring community. We are still concerned about clear cutting and lack of buffers area. We asked for improved landscaping around the basin as this will be adjoining the neighbors. Zone: Pinelands HB

Applicant is seeking major site plan approval for 2 story office building. We reviewed this plan 12-05-07 and requested required Environmental Impact Statement (EIS). EIS was provided. No further comment. Zone: CAFRA M1

Applicant proposing to construct two story 52 unit hotel with manager’s apartment. This is in vicinity of Heggan Ave. We reviewed this plan 07-11-07 and asked for required EIS which still is not present. We cannot support this project without EIS. Zone: Pinelands, HB.

Applicant seeking preliminary subdivision approval for 11 lots, 10 sfds. This is in vicinity of EHT Public Works. No reports were submitted with application, need EIS, need mature tree study as this is wooded area. Zone: Pinelands RG1

Patrick Brittain Sr. – Ridge and Mill Rd.

Applicant seeking preliminary major subdivision for 10 sfds. Because basin will be at the intersection of Mill and Ridge it needs to have exceptional landscaping. Would like to have an EIS based on fact that this is an established upland habitat. Would like to have mature trees on property marked and preserved. Zone: Pinelands RG1

101 Orchard, LLC – Ocean Heights Ave.

Applicant seeking minor subdivision and preliminary site plan approval for 50,000 sf office park to contain bank with drive thru, and 5 one story buildings. This is the area of woods next to the custard stand on Ocean Heights. We did not have the complete plan and could not review. Only the lot realignment. We need an EIS and mature tree study. Zone: Pinelands CHP

T-Mobile Northeast, LLC – Fire Road

Applicant seeking conditional use variance and minor site plan approval for construction of 150 ft. monopole and fenced compound for four electronic equipment cabinets. Site is at Weinstein Supply. We agree with comments submitted by township engineer J. Mott.

Radhey, LLC – Black Horse Pike

Applicant proposing to construct two story 52 unit hotel with manager’s apartment, Ocean Inn. This is in vicinity of Heggan Ave. We reviewed this plan 07-11-07 and asked for required EIS which still was not present. We asked a second time 02-06-08. The EIS was submitted. Although the EIS states there are no wetlands present, Terry Vogt, our Environmental Consultant states there is a small pocket. We need the Pinelands Certificate of Filing to verify presence or absence of wetlands. The EIS indicates possible habitat for Barred Owl. We suggest no variance for lot size. We point out there is a defunct gas station next door which may indicate presence of hazardous substances. Zone: Pinelands, HB.

Creek Development LLC – English Creek Ave.

Applicant seeking major site plan approval for 2800 sf bank with three drive throughs and basin. This is the lot/house next to CVS at West Jersey Ave. We were very distressed at the number of large oaks to be removed, a few as large as 24", several 20" and 18". We ask that whatever can be done to save some of these trees be done, such as reconfiguring the basin. Construction fences must be installed for trees to be saved. Zone: Pinelands HB

Ocean Heights MHP, LLC – Ocean Heights Ave.

Applicant is seeking major site plan approval for 10 lot subdivision to be 8 single family homes, 1 basin and one lot to remain vacant. This is next to Stony Mill Mobile Park. No EIS as required. We cannot support this project without the EIS. Because the basin is on Ocean Heights Ave., we asked that special attention be given to landscaping that area. No mature tree study. Although plans call for no clearing beyond building envelope, unless these lots are deed restricted, the trees will probably be removed by the home owners. Zone: CAFRA RA

Charles Alario c/o Infiniti Builders – Shore Mall

Applicant seeking amended approval for 10,420 sf. restaurant to be Golden Corral Buffet & Grill. No EIS present as required although we would not oppose a waiver due to location. Need irrigation for landscaping upgrades. Zone: Pinelands RCD and R2

Applicant is seeking major site plan approval for 10,558 sf two story office building. Existing sfd to be demolished. We reviewed this application in January 2008 and requested several specimen size trees to remain. Plan shows many specimen trees scheduled to remain with appropriate construction safeguards. We ask that the 24" maple scheduled to be removed be spared if at all possible. Zone: Pinelands, PO1.

Joel Jacovitz – Pine Ave.

Applicant seeking 4 lot subdivision to construct 4 sfd’s. This is at the intersection of Pine Ave and Ocean Heights Ave. No Comment as it is within zoning and Pinelands mandates. Zone: Pinelands RG1

Ma-Len Enterprises, LLC – Ocean Heights Ave.

Applicant is seeking site plan approval for 20,000 sf combination retail/restaurant shopping center. This is close to English Creek Ave, the stand of woods between the carwash and Five Points Farm. We reviewed this application in March of 2007 and it was then reviewed by Terry Vogt, Environmental Consultant. Area was found to contain a distinct wildlife habitat if mixed forest growth and potential presence of Cooper’s hawk. In addition, two specimen Pitch Pines of 90-100’ were identified. We feel a threatened and endangered species study is called for. There was no EIS which is required. No mature trees study presented. We also feel perimeter buffer is not sufficient. We asked to see this application again with the proper studies. Zone: CAFRA NB

Applicant seeking major site plan approval for 4 story hotel. This is in vicinity of Williams Ave. We reviewed this application in November 2007 and April 2008 and requested additional landscaping. It was also reviewed by Terry Vogt who requested additional trees are saved around the basin which we agree with. This would be in keeping with the spirit of the Egg Harbor Township Livable Community Plan keeping as many mature trees along the roads as possible. The basin is to be on English Creek Ave. Plans also indicate site is in "Egg Harbor" Zone: Pinelands HB

Stewart & Miller – Nathan & Issacs Lane

Applicant is seeking preliminary approval for 8 lots, 7 sfds and 1 basin. Plans indicate Nathan Lane will be extended for development. There are numerous mature trees around the perimeter and we ask that special attention go to saving them and perhaps deed restricting. There are trees over 20" diameter in basin, we ask they be saved. Landscaping plan around the basin is poor and should be enhanced. Zone: CAFRA R3

ACAD., LLC – 3373 Bargaintown Rd

Applicant seeking preliminary and final site plan approval for a 6784 sf. one story restaurant on the site of the former Country Cousins Restaurant at Zion and Bargaintown Rds. Existing structure to be demolished. We ask for a Cultural Resource Survey due to the historical nature of the building. The Township historian June Sheridan is able to offer extensive information on the history of this building. We need an EIS. We had hoped to save the existing tree which was over 150 years old; however, we discovered that the tree has already been cut down. This tree should have been designated as a specimen tree. Applicant seeking preliminary and final approval for two 40’ by 60’ pole barns. Applicant proposing two basins. There was no EIS or landscaping plan offered. Zone: Pinelands RG4

Applicant is seeking preliminary subdivision approval for 11 lots, 10 for sfds and 1 basin. This is on Mill Rd., a wooded lot in vicinity of Public Works and Puggis. There is a mature tree study and there are numerous large trees on the property. We saw this plan in August 2008 and asked for an EIS which has been provided and indicates nothing remarkable. Our other previous comments are the same. There is a 20" diameter pine on lot 14.02, is it possible to save this tree by shifting position of the house? We also ask that there be attempt to save the large trees in the basin. Pinelands RG 1

Leonard and Faye Tierno – 311- Ocean Heights Ave.

Applicant is seeking 3 lot subdivision, this is at site of existing Harbor Medical Center. Waiver asked for mature tree study, which is o.k. for subdivision purposes only but applicant will need to provide one with site plans. The same is true when asking for a waiver for required buffer as these lots will back up to existing residential area. Zone: Pinelands NB

Bank of America – 6048 Black Horse Pike

Applicant seeking minor site plan approval for a 1185 drive though kiosk in parking lot of Lowe’s Home Improvement Center. We have no comment. Zone: Pinelands HB

Adam Cross – Ivins Avenue

Applicant seeking preliminary major site plan approval for 37 lots which will have 36 sfds and one basin. There is no EIS which is needed. This application has been reviewed by township’s environmental consultant who noted the presence of many large caliber trees including a 48" oak on the property. The Environmental Commission considers this to be a specimen tree to be preserved, which can be done by adjusting the basin and following proper construction techniques. This will be vital in order the preserve this tree. We also agree that many of the large trees can be preserved by regrading lots. This application well exceeds the 55% clearing limit and we do not support a waiver for this requirement. Lot 3 has several 24" trees which also can be preserved. We recommend the municipal planner read the environmental consultant’s report and work with him on this application. Zone: Pinelands RG 2

Applicant has hired an arborist to asses which trees can be preserved and to use proper construction techniques to preserve them during construction. This application was also reviewed by the township’s environmental consultant.

There is a question of what percentage of mature trees will be saved which is not known. It was suggested that additional trees can be saved by concentrating them in larger parking islands.

At the recommendation of the environmental consultant, applicant will attempt to redesign the basin at the southwest corner of the property to preserve the buffer between the site and neighboring residents.

The area along Old Egg Harbor Rd. and across from existing condos will be bermed in an attempt to lessen the noise of the delivery trucks.

The ingress/egress driveway will now go from BHP through to Hingston Ave.

The EIS needs to be revised and finalized.

Green initiatives will be used for the actual buildings.

Applicant is seeking approval to install additional solar panels on north perimeter of property and around existing solar panels.  Three existing metal buildings to be demolished.  A landscape buffer will be added in two locations on eastern property line.   This property straddles Hamilton and Egg
Harbor Townships.  Site is already cleared and we felt this is a good example of a dual use of property as the panels will be installed on cleared land and over retention basins.  The landscape buffer appears thin on plan and perhaps could be enhanced.  We suggest proposed street trees be either r dwarf or slow growing varieties so as not to interfere with panels in the future along the eastern side.  Zone: Pinelands, C/F

Applicant is proposing a shopping center, The Crossings Center.  It will contain banks, restaurants and retail establishments.  206,470 sf proposed.  This is triangled corner of the intersection, across from Wawa and the car wash.  Although there is a landscaping plan, it is deficient.  Sizes of existing mature trees are not marked.  There is no indication of which trees are to be removed and which are to be saved.  We feel more of the existing mature trees can and should be preserved, particularly in the area of the mobile homes, along proposed streets, around basin.  Proper construction techniques must be used to assure their survival in the long term.  We would also like to see a more detailed landscaping plan for the proposed buildings and around the basin. Applicant is proposing a 4.334 sf multipurpose addition to existing church. We suggest no waiver for wetlands delineation as requested. Additional landscaping should be added, perhaps as islands in the parking area with a few trees. We also suggest the building be designed for possible added solar panels in the future, siting it properly and adjusting the pitch of the roof. Zone: RCD


New Vista – 6124 Black Horse Pike
Applicant is seeking amended site plan approval, was approved for two professional office buildings. Amended application is for one story retail building with a mezzanine level office. We feel that with some minor redesign of the driveway, the 24” diameter tree can be saved. We recommend a revised landscaping plan reducing the total number of trees to be planted around the basin and adding native shrubs and grasses. The large number of trees proposed will grow to complete with each other and lead to removal of the trees in the future and there is no access to the basin for maintainence. Need an EIS

Applicant proposes to construct Super WaWa at corner of Fire Rd and BHP. We agree with planners landscaping comment but feel it should show more native shrubbery, particularly around the basin.
